A custody dispute between actors Halle Berry and Olivier Martinez has moved into open court. A Los Angeles County judge granted Martinez a temporary restraining order against Berry on Thursday, October 1, covering both him and their son Maceo, according to court records viewed by People.

What Martinez alleges

Martinez says Maceo phoned him and said Berry had physically attacked him and put him in a chokehold. The filing places the incident at Berry’s home the previous Saturday night, and claims she jumped on the 12-year-old and put her hands around his neck. Martinez is also asking for sole custody, and wants Berry barred from drinking or being under the influence of substances around their son.

His filing includes screenshots of text messages between the former couple as exhibits. In one, Berry reacts to the situation by asking what kind of child they are raising, and in another she tells Martinez that what he is doing is wrong.

Berry’s response

Berry’s lawyer gave TMZ a statement calling the allegations outrageous conduct and saying she is used to it from Martinez. Her legal team has also called the filing meritless and deliberately misleading, and pointed to Martinez’s past behavior.

Limits of the order

Berry must stay 100 yards from Martinez, but the judge declined to block her access to Maceo. The order is temporary, and nothing has been decided on the underlying claims.

A history of conflict

Berry’s team’s reference to past behavior appears to point to a 2012 Thanksgiving altercation at Berry’s home. Her then-boyfriend Gabriel Aubry, father of her daughter Nahla, alleged Martinez threatened to kill him and slammed his head on a concrete driveway. Berry’s side at the time said Aubry was the aggressor. Police reports at the time reportedly indicated Martinez acted in self-defense, and Aubry was not charged.

The timeline

The pair met on the set of Dark Tide in 2010, married in France in July 2013, and welcomed Maceo that October. They announced their split in October 2015 after two years of marriage. The divorce was finalized in 2023. Berry is also mother to Nahla, 18.

A hearing date had not been reported in the coverage available at the time of writing.
